These Terms of Service ("Terms") govern your access to and use of the services provided by Oneway Africa Technologies ("we", "us", "our"), including web hosting, domain registration, business email, SSL certificates, VPS servers, website design, mobile application development and systems/software development services (collectively, the "Services"). By ordering, accessing, or using any of our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, placing an order, or using any Service provided by Oneway Africa Technologies, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and any service-specific terms referenced herein. If you do not agree to these Terms, you must not use our Services.

2. Our Services

We provide web hosting (cPanel and DirectAdmin), domain name registration (including .co.tz and other extensions), business email hosting, SSL certificates, Cloud VPS servers, website design, mobile application development, and systems/software development services. Specific features, resource limits, and deliverables for each Service are described on the relevant order/product page at the time of purchase.

3. Account Registration & Responsibilities

You must provide accurate, current, and complete information when creating an account or placing an order. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect any unauthorized use of your account.

4. Payments & Billing

Fees for Services are due as set out at the time of order and on each renewal date, in accordance with your selected billing cycle. We accept payment via mobile money (including M-Pesa, Mixx by Yas, and Airtel Money), bank transfer, and card payments where available. It is your responsibility to ensure invoices are paid on or before their due date to avoid service suspension.

5. Refunds & Cancellations

Refund eligibility, where applicable, will be communicated at the time of purchase or is available on request from our support team. Domain registration, transfer, and renewal fees are generally non-refundable once processed, as these are paid to third-party domain registries. You may cancel a recurring Service at any time from your Client Area; cancellation will take effect at the end of the current billing period unless otherwise agreed.

6. Acceptable Use

You agree not to use our Services to host, transmit, or distribute any content that is illegal, infringes on the rights of others, contains malware, or is used for spamming, phishing, denial-of-service attacks, or other abusive or fraudulent activity. We reserve the right to suspend or terminate any Service found to be in violation of this policy, with or without notice, depending on the severity of the violation.

7. Service Availability

We aim to maintain high service availability for our hosting and infrastructure Services, and will make reasonable efforts to notify customers in advance of planned maintenance that may cause downtime. We are not liable for downtime caused by circumstances outside our reasonable control, including but not limited to power outages, internet backbone failures, or force majeure events.

8. Website Design & Development Projects

For website design, mobile application development, and systems/software development projects, the specific scope, timeline, deliverables, and pricing will be agreed upon separately with each client prior to commencement of work. Any revisions, additional features, or scope changes requested outside the agreed scope may be subject to additional charges.

9. Intellectual Property

Unless otherwise agreed in writing, you retain ownership of content you upload to your hosting account or provide for a custom development project. Oneway Africa Technologies retains ownership of its own software, tools, templates, and pre-existing intellectual property used in the delivery of Services, except where otherwise agreed as part of a custom development contract.

10. Limitation of Liability

To the fullest extent permitted by law, Oneway Africa Technologies shall not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, our Services, including loss of data, revenue, or business opportunities. Our total liability for any claim arising from these Terms shall not exceed the amount paid by you for the applicable Service in the three (3) months preceding the claim.

11. Termination

We may suspend or terminate your access to any Service if you breach these Terms, fail to pay applicable fees, or engage in activity that we reasonably believe poses a risk to our infrastructure, other customers, or third parties. You may terminate your Services at any time through your Client Area or by contacting our support team.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Republic of Tanzania. Any disputes arising from these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts of Tanzania.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services or for legal or regulatory reasons. Material changes will be communicated via email or a notice on our website. Continued use of our Services after such changes constitutes acceptance of the updated Terms.
